MUNICIPAL LAW

Municipal Law is a unique yet broad area of the law that can include the representation of governmental bodies or the representation of private clients appearing before governmental bodies. The attorneys at Davison & McCarthy, P.C. are experienced in both facets of municipal law.

In its representation of governmental bodies and agencies, our attorneys have provided legal representation and guidance to townships, councils, boards, zoning hearing boards, planning commissions and municipal authorities. As part of this representation, our attorneys have attended and conducted public meetings and hearings; provided legal guidance and opinions to municipal bodies and officials; represented municipalities in front of a variety of courts; performed legal research; reviewed and prepared contracts, agreements and legal documents; negotiated purchases and sales of real and personal property including eminent domain; reviewed and prepared comments to subdivision and land development plans; drafted a variety of ordinances, resolutions and policies.

We have also represented individuals, corporations, institutions and neighborhood groups before a variety of governmental and quasi-governmental agencies. This representation includes representing property owners and/or developers seeking subdivision and land development approvals; in zoning and land use appeals; in defending against enforcement actions; in condemnation (eminent domain) actions; and in asserting concerns related to pending governmental actions.

Having represented both municipal and private clients and having attorneys who have served on the court and other tribunals, we are uniquely equipped to provide our clients effective and efficient representation.

Our firm's understanding of municipal law is greatly enhanced by the skills of Maxwell Davison who served on the Court of Common Pleas in Lehigh County for nearly twenty years. In that capacity, Attorney Davison heard and decided many cases related to municipal law issues. In addition, another of our attorneys, Daniel McCarthy, is very active in municipal activities and has served as Assistant City Solicitor to the City of Allentown, Solicitor to the South Whitehall Township Authority, Northampton County Assistant Public Defender, Special Counsel to the Allentown Fire Civil Service Commission and on the Allentown Police Civil Service Commission. Mr. McCarthy is the current Solicitor to the Allentown Parking Authority, and is President-Elect of the Bar Association of Lehigh County.
