TYPES OF LAW

ARBITRATION, MEDIATION AND OTHER ALTERNATIVE DISPUTE RESOLUTION

Our business and individual clients are increasingly turning to various forms of alternative dispute resolution to address their legal matters. The attorneys at Davison & McCarthy have extensive experience in serving as arbitrators and mediators as well as advocating on behalf of our clients in various forms of alternative dispute resolution settings. The goal is to avoid the considerable time and expense that is associated with traditional litigation in a court of law. Our experience includes:

  • Representing our clients before arbitrators, mediators and other alternative dispute resolution forums;
  • Advising clients on the various forms of alternative dispute resolution options;
  • Drafting alternative dispute resolution provisions in contracts and other legally binding documents; and
  • Serving as neutral arbitrators and mediators in private alternative dispute resolution as well as court appointments or through the Financial Industry Regulatory Authority (FINRA).

In many instances, our clients have achieved significant cost savings by utilizing mediation for an early settlement in a case. Furthermore, the use of binding arbitration has, in some instances, been less costly than a trial would have been. In a number of cases, the issues in a case have been narrowed through the use of alternative dispute resolution, thereby making the trial more cost effective and efficient. Davison & McCarthy is well-equipped to represent its clients in alternative dispute resolution forums and favors the use of alternative dispute resolution in any form when it serves our client's best interests.
